Risk Assessments (Articles 6 to 8)

In addition to obligations imposed on the EU Commission (Article 6), and Member States (Article 7), obliged entities under Article 8 must (i) take appropriate steps to identify and assess the risks of money laundering and terrorist financing, taking into account specified risk factors (ii) document their risk assessments, keep them up to date and made them available to relevant NCAs; (iii) and have policies controls and procedures in place to mitigate and effectively manage money laundering and terrorist financing.

These should include developing internal policies controls and procedures to include reporting, record keeping, internal control and compliance management. There is also a requirement to have an independent audit function to test internal policies, controls and procures where this is appropriate having regard to the size and nature of the firm (Article 8).
