Obliged entities (those who have to comply) (Article 2 to Article 4)

The entities within the scope of the new EU Regime,  including credit institutions, financial institutions (as defined), auditors, external accountants and tax advisers, notaries and other independent legal professionals, trust and company service providers, estate agents, persons trading in goods (thresholding reduced to 10,000 Euro), providers of gambling services, providers engaged in exchange services between virtual currencies and fiat currencies and custodian wallet providers (see Articles 2 and 3 of MLD4 as amended by MLD5 for the full list).

Member States must ensure that the obligations are extended in whole or in part to professions and categories of undertaking that engage in activities that are particularly likely to be used for money laundering or terrorist financing purposes (Article 4(1)).  Where a Member State does so, it must inform the EU Commission (Article 4(2)).
